Combination of a payment

Payment for access to commercial use of immaterial rights will typically involve a combination of a one-time payment plus royalties.

An alternative payment can be a charge per unit calculated on the basis of sales, taking into account the use of the invention.

Payment can also be in the form of shares in the company buying the rights.

Buying research services

Often the transfer of rights will result in the company buying research services from the institutions. This in turn to further develop the technology, since it is typically transferred before it is fully developed.

The transfer of rights in joint projects should, however, reflect the company´s own contribution in connection with the collaboration.

This means that if the joint project is supported primarily by public financing, the company in question can - as a starting point - only acquire limited access to the rights adhering to the research institution in the collaboration.

Market conditions

The research institutions operate on the policy that payment for immaterial rights should be fair and in agreement with normal market conditions.
